The Federal Motor Carrier Safety Regulations, Section 391.21, which covers Driver's Qualification and application for employment, requires the motor carrier to obtain a list of all motor vehicle violations for the last three (3) years.
In Ontario, this is known as a Commercial Vehicle Operator Record Driver Abstract. It is company policy to obtain a list of both commercial and personal motor vehicle violations for each driver operating under its authorities, on a periodic basis.
As a condition of my contract of service, I hereby provide written authorization for 2004420 ONTARIO INC./RAIDER LOGISTICS to obtain such information. I have read and understand the above conditions.
MULTIPLE-EMPLOYER DRIVERS
INSTRUCTION: If a motor carrier employs a person as a multiple-employer driver (as defined
in49 CFR 390.5), the motor carrier shall comply with all requirements of part 391, except the carrier need not

Purpose:
The philosophy of 2004420 ONTARIO INC./RAIDER LOGISTICS is to treat all drivers and Contractors in a friendly, firm and fair manner. It is further the policy of 2004420 ONTARIO INC./RAIDER LOGISTICS That whenever appropriate the guidelines of Progressive Disciplinary Action be exercised.
Scope:
Any driver or Owner Operator who has committed an infraction will be subject to the following:
First offense: Verbal Warning
This will be documented as a verbal warning and become a part of the Driver's I Owner Operators violation file.
Second Offense: Written Warning
As above documented and placed in violation file.
Third Offense: Suspension and or Final Written Warning
At the company's discretion this is a last chance before termination of contract or driver removed from contract.
Fourth Offense: Termination of employee.
Other:

When the application for employment is submitted in person, if the Prospective Employer uses any info1mation it obtains from FMCSA in a decision to not hire you or to make any other adverse employment decision regarding you, the Prospective Employer will provide
you with a copy of the report upon which its decision was based and a written summary of your rights under the Fair Credit Reporting Act before taking any final adverse action. If any final adverse action is taken against you based upon your driving history or safety
report, the Prospective Employer will notify you that the action has been taken and that the action was based in part or in whole on this report.
When the application for employment is submitted by mail, telephone, computer, or other similar means, if the Prospective Employer uses any information it obtains from FMCSA in a decision to not hire you or to make any other adverse employment decision regarding you, the Prospective Employer must provide you within three business days of taking adverse action oral, written or electronic notification: that adverse action has been taken based in whole or in part on information obtained from FMCSA; the name, address, and the toll free telephone number of FMCSA; that the FMCSA did not make the decision to take the adverse action and is unable to provide.

Neither the Prospective Employer nor the FMCSA contractor supplying the crash and safety information has the capability to correct any safety data that appears to be incorrect. You may challenge the accuracy of the data by submitting a request to https://dataqs.fmcsa.dot.gov. If you challenge crash or inspection information reported by a State, FMCSA cannot change or correct this data. Your request will be forwaded by the DataQs system to the appropriate State for adjudication.
Any crash or inspection in which you were involved will display on your PSP report. Since the PSP report does not report, or assign, or imply fault, it will include all Commercial Motor Vehicle (CMV) crashes where you were a driver or co-driver and where those crashes
were reported to FM CSA, regardless of fault. Similarly, all inspections, with or without violations, appear on the PSP report. State citations associated with Federal Motor Carrier Safety Regulations (FMCSR) violations that have been adjudicated by a court of law will also appear, and remain, on a PSP report.
The Prospective Employer cannot obtain background reports from FMCSA without your authorization.

FATIGUE DRIVING
We acknowledge many safety risk associated with Driver Fatigue. Consequently the Safety management has developed the following.
ZERO TOLERANCE
Effective immediately;
No driver shall operate any equipment for or on behalf of the Company while he or she is in a fatigue state.
If a driver is in such Fatigued state, he or she shall contact the dispatch immediately and take rest.
Drivers who fail to comply with this policy shall be subjected to disciplinary action such as suspension or termination.
HOURS OF SERVICE RULES
Drivers must ensure that the daily log is always updated and properly recorded to the last change of Duty Status.
Drivers must ensure that any receipts/bridge toll/ fuel/ Border crossing documents is accurately recorded on the driver log and original or copies of the receipts are left in the trip envelopes for compliance reasons.
CANADIAN RULES:
- 70 Hours in 7 days' cycle
- 13 hours of "Driving time"
- 14 hours of "On-duty time"
- Drivers must have consecutive hours off duty/sleeper berth for daily reset.
- Drivers must have 36 hours "off-duty" for 70 hour reset.
Note: Canadian drivers must in compliance with the U.S HOS before entering in the United States.
USA - PROPERTY CARRYING RULES:
- 70 Hours in 8 days' cycle
- 11 Hours of driving time - after 10 consecutive hours off
10 hours of straight off duty.
10 hours straight sleeper berth.
- 14 hours of elapsed time
- CHANGES TO U.S HOS EFFECTIVE JULY 1. 2013
Take at least 30 minutes of "OFF DUTY" between 5th to 8th hour- the 30 minute is part of the 14 hours
Note: Canadian drivers must take 36 hours reset to comply with Canadian Hours of Service.
POLICY REGARDING ALCOHOL AND COMMERCIAL MOTOR VEHICLE
Important Information Concerning U.S. Country Wide
Per section 392.5 of the Federal Motor Carrier Safety Regulations, the U.S. has a ZERO TOLERANCE policy regarding alcohol in a commercial motor vehicle. This means the following:
- 1. Drivers are forbidden to use or possess alcohol at any time in a commercial motor vehicle.
- 2. Alcohol cannot be anywhere on or in a commercial vehicle. It does not matter if the alcohol is sealed, out of reach of the driver, or in the trailer.
- 3. There are NO exceptions for purchase of alcohol at duty free facilities. If a duty free facility is on U.S. soil of if purchased in Canada for export to the U.S. the alcohol restriction still applies.
- 4. Drivers cannot be on duty or operate a commercial motor vehicle if they have used alcohol with in the past 4 hours.
- 5. The same rules apply to any workers, passengers, or co-drivers transported in a commercial motor vehicle.
Consequences of violating these rules include the following.
- 1. Driver is placed out of service and cannot move the truck for 24 hours.
- 2. Driver is issued a ticket by law enforcement ( amount varies by jurisdiction)
- 3. Out of service inspection Impacts Company's SafeStat score which can lead to compliance reviews and higher insurance premiums.
- 4. Enforcement action can be taken against company through an onsite compliance review. This can include fines or suspension of a company's ability to operate.
** The following are the only limited exception to this rule:
The alcohol is manifested and is part of the shipment (example shipment of beer)
Alcohol is possessed or used by passenger of a bus only.
The vehicle is not being used as a "commercial" vehicle and solely being driven for personal reason. (example driver is using a tractor without a trailer to drive to hotel as personal transportation)

DRIVER ACKNOWLEDGEMENT
SPEED LIMITS
The company's maximum speed limit is 105 Kph
At no time is either the posted speed limit or the company limit to be exceeded. Drivers must at all times operate their vehicles at speeds that are reasonable and prudent, taking into consideration traffic, weather, and road conditions. When traveling more slowly that the general traffic flow, such as when climbing long hills, four-way flashers are to be used.
By signing below driver acknowledge that he/she will obey the company speed limits all time.
SEAT BELT POLICY
It is the policy of our company, and a condition of employment, that all employees who operate or ride in company vehicles; or operate or ride in personal vehicles on company business, wear properly fastened and adjusted seat belts, shoulder harnesses, and other such similar equipment when provided in the vehicle they are operating or riding in. Employees are required to report any malfunction of seat/shoulder belts, and to have this equipment repaired or replaced as soon as possible after its discovery. Any employee found operating or riding in a company vehicle, or personal vehicle on company business without seat belts/shoulder harnesses fastened will be subject to disciplinary action, up to and including termination. "Operating" and "riding in" are to be defined as occupying a moving vehicle.

Paperwork Policies
- • Envelope must be dropped every week. After 2 weeks dispatch will be stopped if the envelope is not received and it has to be filled out properly: cities, KMs and Fuel.
- • Use one envelope for each side. Example 1 from ON to TX and other
from TX to back.
- • When load has been picked, paperwork must be sent before going out of the customer's property. It does not matter if the log-book is running out of hours or customer is not letting you stay there. ACI or ACE trip sheet must be filled out with the border referred by you. Trip number will not be change afterwards.
- • ACI or ACE could be faxed only between 8 am- 5 pm from Monday Friday.
- • POD has to be signed from the customer yard with BOL signed and the name of Receiver must be readably printed on it. Make sure to inform the dispatch if customer writes anything on the POD.
- • You will receive dispatch within 15 minutes after sending the POD.
- • Once you receive the dispatch please read it twice for the time and date of
the pickup.
- • No excuses for tarping if the dispatch says so.
- • If you need the waiting time, kindly send us an email once arrived at the customer and update us every hour. Waiting time depends on the different customers (It could start after 2 hours or 3 hours) as whitby and tarping does not provide waiting time. It can be sorted out once the load is delivered because we cannot assume the time taken for delivery.
- • Share the picture for every load you pick before and after tarping in company's whatsapp group.
- • If there is an APPOINTMENT then you should reach there by time. Recently, we have paid $2000 for a missed appointment.
- • Maintenance report and PM has to be on time otherwise dispatch will be ceased.
- • If you got pulled over by DOT or Police, send us the reports right away. In case you failed to do so and it is found by the company or Insurance later on can lead to the termination.
- • You will earn $100 with every passed inspection and lose $100 Cad with every failed one.
- • If you get out of Hours-of-Service, it will cost you either $500 Cad or termination depending upon the violation.
- • Check your load every 4 hours.
- • Any call from random people on the road can put you in the safety classes.
- • No passenger is allowed.
Trailer Switch Policy
- • Trailers owned by Owner operators should have the complete accessories as required in their trailers.
- • None ofthose accessories should be kept in their own trucks.
- • Trailers owned and operated by owner operators must be fully maintained at all times.
- • An owner operator is responsible for their own trailer repairs.
- • Ifthe trailer is switched and got damaged, the driver at that time is accountable for taking care ofall the repairs and its expenses.
- • When switching loads in the yard, it is the duty ofthe driver dropping the load to make sure the necessary load paperwork is in the trailer. Failure to do so will result in fine ofup to $100.
- • Ifany driver asks for the paperwork while on delivery location then you will be charged $100.
- • Trailer rent is $1100 as of June 01, 2024.
DVIR: Inspecting the truck before the trip.
- • Conduct a full pre-trip and post-trip Inspection of every commercial motor vehicle you drive. There must be random inspections on-route.
- • It is unsafe to drive a vehicle with defects and it is the responsibility of the driver to ensure he/she is operating safe equipment at all times and inform the dispatch of any defects discovered.
- • You ought to be trained on proper procedures of conducting Pre-Trip & Post-Trip Inspections also on coupling, uncoupling and 5th wheel tug test.
- • You are responsible for the load you are picking or going to deliver. For instance, if the load has been picked up by one driver and it had some defect which the first driver did not notice, now other driver has to deliver it, he will note the defect in his pre-trip and would inform the officials about it so that he should not be accused of any loss. Here, shipper could be at fault but the first driver did not report it so the driver will be assumed to be guilty for this defect. If the same happens then the first driver would have to pay for the loss.
Vehicle maintenance
- • It is the driver's responsibility to be sure that the truck is in safe operating order. If there is an issue, you should inform the company's mechanic and get it fixed. It is essential that tires, lights along with brakes are adequately maintained.
- • It is important to get every minor defect checked and repaired, any failed inspections will lead to adverse consequences to the driver (May be a warning or deductions; depends upon the severity).
- • Maintenance reports must be provided before 10th of every month, failure to do so may result in ceasing dispatch for a day or two to that particular driver.
- • Preventive maintenance must be done every 3 months and reports must be provided. We had most of the failed inspections due to vehicle maintenance issues so this has to be adhered strictly.
- • No excuses would be entertained, there would not be repetitive calls but dispatch would be stopped by the time monthly maintenance reports are not received.
Pacing oneself: The appropriate speed to drive
- •It is vital that truck drivers drive within the speed limit. Over speeding can lead to accidents.
-
- • Drivers must operate their vehicle at speeds that are reasonable and prudent, taking into consideration traffic, weather and road conditions.
- • When travelling more slowly than the general traffic flow, such as when climbing long hills; four-way flashers are to be used.
- • Also, kindly avoid road rage. We have got some complaints for the drivers being involved in road rage. We request you to ignore such other drivers on the road and driver safe.
- • Driving beyond 105 kmph is unacceptable. If any of the drivers
gets a speed ticket, it does not only cost you a charge but some company points as well. Therefore, any speeding ticket will lead to a warning or suspension depending upon the intensity of the violation.
- • It is mandatory to provide us with the proof that your vehicle is locked at 105 km/h.
Emerging Trends: Follow state and country regulations.
- •We need to know the importance of following any state, federal and country regulations present when it comes to trucks. The driver does not want to be faced with the difficulty of being stopped by the Department of Transportation inspectors and not be following the regulations in place.

- • Roadside violations may become prominent on the driver's documents for 3-5 years. This can impact your chance of employment in future.
- • Any Inspection done either passed or failed should be reported to safety on the same day.
- • Kindly try to keep your vehicle maintained and add defects to your DVIRs if there is any. Failure to report any inspection to the safety could lead ceasing of dispatch for 2 days after reporting.
- • If the inspection would be Out-of-Service because of vehicle defect or any hours-of-service issue, forbid me but the consequences would be harsh.
- • You will also receive $100 for every clear inspection (Only if we receive the inspection on time) and also deduction of $100 for each failed one.
Hours of Service Rules
- • You must ensure that the daily log is always updated and properly
recorded to the last change of duty status. It is important to certify the logs
at the end of each 24 hour period. I have seen some of us not certifying the
logs for more than a week. Kindly start practicing to certify logs every day.
- • It is mandatory to take 30 minutes of "OFF DUTY" for every 8 hours of on
duty and driving times.
- • Please note that if you are using split sleeper berth in states then the duty
time which is 7+ hours must be in sleeper berth and other 2+ hours could
be any, sleeper berth or off-duty. It does not count towards Split-sleeper
berth if 7+ hours status is in off-duty.
- • Paper-logs must be dropped bi-weekly. Fill shipping details properly on
the log and fuel-marks must be accurate.
- • Company allows you to use Personal conveyance for 45 minutes in a
single day that too in a thorough need.
- • Personal conveyance or yard move will be disabled for the person who will
misuse it.
Distracted Driving
- • Using your cell phone to talk, text, check maps or choose a playlist while you are behind the wheels, all count as distracted driving- it can put you and others at risk.
- • Activities like eating, reading, smoking, grooming, typing a destination
into GPS are not allowed while driving. You must stop at a safe spot to do
any of the distracting activities or get everything organized while pre-trip
inspection.
- • A hands-free device can be used limitedly.
- • A mounted device (e.g. phone, GPS) can be used as long as it is secure and
not moving around while driving.
- • Absolutely NO hand-held devices are allowed to use while driving or
while waiting at red light.
- • Anyone convicted of it could be terminated with a single warning.
Fire Precaution Policy

back door, both are easily accessible.
In the event of fire:
- • Rescue the person(s) immediately from the fire scene or room.
- • Confine the fire by closing all doors to the room.
- • Extinguish a small fire by using portable fire extinguisher or use to
escape from large fires

Company Driver Rules
- • Obey traffic laws in your jurisdiction and be courteous towards other drivers.
- • Document driving expenses.
- • Monitor gas, tire pressure and fluid levels.
- • Report any damage or problems to your assigned vehicle immediately.
- • Report changes to your driver privileges, such as driver's license suspension, immediately.
- • Always lock company vehicle when you are not around.
- • Do not drive while intoxicated, fatigued, or on medication that affects your driving ability.
- • Do not smoke in any company vehicle.
- • Do not use a phone or text while driving.
- • Do not allow unauthorized drivers to use a company vehicle unless required by an emergency.
- • Company is not responsible for paying the fines that employees receive while driving company vehicles they are responsible for.
- • Company is not responsible for posting bail for employees who are arrested while driving company vehicle.
- • Company drivers are fully responsible for all company owned products like Tarps, Chains, Binders, Straps, Bunges, Etc.
Property Loss Procedures
- 1. Notify all authorities involved, such as fire, ambulance, police, building inspectors etc.
- 2. Notify the Company Staff as soon as practicable and report the loss.
- 3. Protect the property from further damage.
- 4. Immediately separate damaged and undamaged property.
- 5. Obtain the names and contact information of all staff and independent witnesses involved in the loss. Also, make note of any possible involvement of other parties.
- 6. Retain any piece of equipment or other damaged property that may assist in identifying the cause of damage. These items should be tagged and identified as to its function in order to assist in establishing the underlying cause of the loss.
- 7. Take photographs, if possible, prior to the removal of any debris.
- 8. Establish a loss control account to detail all expenses incurred as a result of the loss.
- 9. Retain all estimates and invoices, time sheets, etc. to ensure that all costs attributed to the loss are captured. A complete inventory of all property detailing the quantity, description of the damaged property including the manufacturer, model number and serial number, current replacement value as well as copies of invoices evidencing repair and/or replacement of the damaged property.
- 10. Complete an Accident report form and submit it to the safety along with a copy of all civil authority's incident report for processing and to determine next steps.

THE 7-STEP INSPECTION PROCESS
