Introduction

Your response to the statements in Part 2 will indicate whether you are an independent operator or a worker under the Workplace Safely & Insurance Act (the Act).

Workers are automatically entitled to benefits provided by the Act and their employers must pay premiums to the Workplace Safety & Insurance Board (WSIB).

Independent operators are not automatically covered under the Act but may elect to be considered "workers" and covered under the Act. If independent operators choose to be covered, they must obtain optional insurance in their own WSIB accounts. The independent operator is responsible for paying for their own WSIB insurance. Once they have obtained optional insurance with the WSIB. the independent operators and their dependents may lose their right to sue for dama-ges resulting from a work-related accident. The amount of optional insurance selected must reflect the independent operator's annual earnings for labour. The minimum period for optional insurance is three months.

Principal means the company, carrier or shipper that hires you to transport goods.

Who should complete this form?

  • • Owner-operators
  • • the principals that hire them (or their respective representatives).

After completing Part 2 of this form, if the responses indicate that the owner-operator is an independent operator, the owner-operator and the principal must sign the form on page 2 to verify that the statements reflect the work relationship and send it to the Workplace Safety & Insurance Board, Employer Service Centre, 200 Front St. West, Toronto, Ontario M5V 3J1 for confirmation.

The independent operator may request optional insurance and the establishment of their own WSIB account in the "Request for Optional Insurance" section on page 3.

Part 1

What services does the owner-operator provide for the principal? (Describe the equipment).

Does the owner-operator have a previous or current WSIB account number?

Yes   No

Part 2

Owner-operators will be treated as independent operators, for workplace safety and insurance purposes only, when the work relationship contains all the following features:

  • (a) The owner-operator pays for the truck and a majority of the equipment or other related property (such as payments for gas, maintenance of the truck, licence and storage) and is not required to finance the truck and equipment/related property through company sources.
  • (b) The owner-operator has the right to exercise a choice in selecting and operating the vehicle and has market mobility in that he/she has discretion to enter into contracts of any duration to transport goods and maximize profits.
  • (c) The principal does not have the right to control where or from whom products/services are purchased by the owner-operator (however, this does not preclude the owner-operator from exercising his/her option to purchase products/services from the company). Also, the principal does not have the right to exercise control over the owner-operator's operations except to the extent that loads are offered, and destinations and delivery schedules are established by the principal's contract with the shipper and except for the joint responsibilities set out in federal and provincial licensing and related statutes.
  • (d) The principal and the owner-operator state that the relationship is one of a contract for service and not that of employer and employee.
  • (e) The principal does not issue a Canada Revenue Agency T4, T4A or make statutory deductions for E.I. and/or C.P.P.

To the best of my knowledge, information and belief, the work relationship contains all the features stated above.

I/we understand that the WSIB reserves the right to verify that the work relationship contains all the features stated above. If the work relationship does not have all of these features, the WSIB may reverse the determination of status retroactively to the date that the relationship began.

Personal information on this form is collected under the authority of the Workplace Safely & Insurance Act, 1997, and may be used to register/determine your status for coverage and to administer and enforce the Act. If you have any questions, please call 1-800-387-0750.

What To Do If An Accident Happens

The Workplace Safety & Insurance Act requires you to file a report within three days of learning of an occupational injury or disease that disables a worker or requires health care. Failure to do so may result in a late filing penalty being levied. This report of accident must be submitted on a Form 7 - Employer's Report of Injury/Disease.

  • • No excuses for tarping if the dispatch says so.
  • • If you need the waiting time, kindly send us an email once arrived at the customer and update us every hour. Waiting time depends on the different customers (It could start after 2 hours or 3 hours) as whitby and tarping does not provide waiting time. It can be sorted out once the load is delivered because we cannot assume the time taken for delivery.
  • • Share the picture for every load you pick before and after tarping in company's whatsapp group.
  • • If there is an APPOINTMENT then you should reach there by time. Recently, we have paid $2000 for a missed appointment.

  • • No passenger is allowed.

Trailer Switch Policy

  • • Trailers owned by Owner operators should have the complete accessories as required in their trailers.
  • • None ofthose accessories should be kept in their own trucks.
  • • Trailers owned and operated by owner operators must be fully maintained at all times.
  • • An owner operator is responsible for their own trailer repairs.
  • • Ifthe trailer is switched and got damaged, the driver at that time is accountable for taking care ofall the repairs and its expenses.
  • • When switching loads in the yard, it is the duty ofthe driver dropping the load to make sure the necessary load paperwork is in the trailer. Failure to do so will result in fine ofup to $100.
  • • Ifany driver asks for the paperwork while on delivery location then you will be charged $100.
  • • Trailer rent is $1100 as of June 01, 2024.

DVIR: Inspecting the truck before the trip.

  • • Conduct a full pre-trip and post-trip Inspection of every commercial motor vehicle you drive. There must be random inspections on-route.
  • • It is unsafe to drive a vehicle with defects and it is the responsibility of the driver to ensure he/she is operating safe equipment at all times and inform the dispatch of any defects discovered.
  • • You ought to be trained on proper procedures of conducting Pre-Trip & Post-Trip Inspections also on coupling, uncoupling and 5th wheel tug test.
  • • You are responsible for the load you are picking or going to deliver. For instance, if the load has been picked up by one driver and it had some defect which the first driver did not notice, now other driver has to deliver it, he will note the defect in his pre-trip and would inform the officials about it so that he should not be accused of any loss. Here, shipper could be at fault but the first driver did not report it so the driver will be assumed to be guilty for this defect. If the same happens then the first driver would have to pay for the loss.

Vehicle maintenance

  • • It is the driver's responsibility to be sure that the truck is in safe operating order. If there is an issue, you should inform the company's mechanic and get it fixed. It is essential that tires, lights along with brakes are adequately maintained.
  • • It is important to get every minor defect checked and repaired, any failed inspections will lead to adverse consequences to the driver (May be a warning or deductions; depends upon the severity).
  • • Maintenance reports must be provided before 10th of every month, failure to do so may result in ceasing dispatch for a day or two to that particular driver.
  • • Preventive maintenance must be done every 3 months and reports must be provided. We had most of the failed inspections due to vehicle maintenance issues so this has to be adhered strictly.
  • • No excuses would be entertained, there would not be repetitive calls but dispatch would be stopped by the time monthly maintenance reports are not received.

Pacing oneself: The appropriate speed to drive

  • •It is vital that truck drivers drive within the speed limit. Over speeding can lead to accidents.
  • • Drivers must operate their vehicle at speeds that are reasonable and prudent, taking into consideration traffic, weather and road conditions.
  • • When travelling more slowly than the general traffic flow, such as when climbing long hills; four-way flashers are to be used.
  • • Also, kindly avoid road rage. We have got some complaints for the drivers being involved in road rage. We request you to ignore such other drivers on the road and driver safe.
  • • Driving beyond 105 kmph is unacceptable. If any of the drivers gets a speed ticket, it does not only cost you a charge but some company points as well. Therefore, any speeding ticket will lead to a warning or suspension depending upon the intensity of the violation.
  • • It is mandatory to provide us with the proof that your vehicle is locked at 105 km/h.

Emerging Trends: Follow state and country regulations.

  • •We need to know the importance of following any state, federal and country regulations present when it comes to trucks. The driver does not want to be faced with the difficulty of being stopped by the Department of Transportation inspectors and not be following the regulations in place.
  • • Roadside violations may become prominent on the driver's documents for 3-5 years. This can impact your chance of employment in future.
  • • Any Inspection done either passed or failed should be reported to safety on the same day.
  • • Kindly try to keep your vehicle maintained and add defects to your DVIRs if there is any. Failure to report any inspection to the safety could lead ceasing of dispatch for 2 days after reporting.
  • • If the inspection would be Out-of-Service because of vehicle defect or any hours-of-service issue, forbid me but the consequences would be harsh.
  • • You will also receive $100 for every clear inspection (Only if we receive the inspection on time) and also deduction of $100 for each failed one.
